Terms of Service

VolleyForge (“VolleyForge,” “we,” “us,” or “our”) operates a pickleball community platform: player profiles, league and tournament management tools, schedules and standings, and related features (collectively, the “Service”). These Terms of Service (the “Terms”) govern your access to and use of the Service. If you do not agree to these Terms, do not use the Service.

1. Who may use VolleyForge

You must be 18 years or olderto create an account or use the Service. By using the Service you represent that you are at least 18 years old and that all information you provide is accurate. We may suspend or remove accounts we reasonably believe do not meet this requirement. Organizers who add players to a roster are separately responsible for any consents needed from those players and their guardians (see “Organizers” below).

2. Your account

Some features require an account. You agree to provide accurate, current information and to keep it up to date, and you are responsible for all activity that occurs under your account. Keep your password confidential and notify us promptly of any unauthorized use. You may not share your account, create an account for anyone else without authorization, or use another person’s account without permission. We may suspend or terminate accounts that violate these Terms or that create risk or harm to other users or to the Service.

3. Acceptable use

You agree to use the Service lawfully and respectfully. You will not:

• break any applicable law or regulation, or infringe anyone’s rights;
• harass, threaten, defame, stalk, or harm other users, on or off the platform;
• post content that is illegal, hateful, obscene, deceptive, or that impersonates another person;
• submit false scores or standings, manipulate results, or misrepresent a league, team, or player;
• attempt to access accounts, data, or systems without authorization, or probe, scan, or disrupt the Service;
• scrape, harvest, or collect other users’ data, or use bots or automated means except as we expressly permit;
• upload malware, or interfere with the integrity, security, or performance of the Service;
• use the Service to send spam or unsolicited commercial messages, or for any purpose it was not intended for.

4. Leagues, organizers & teams

If you create or administer a league, tournament, team, or roster (an “organizer”), you are responsible for the accuracy of the information you publish, for how you run your events, and for your communications with the players you invite. VolleyForge provides the tools; it does not organize, sanction, officiate, or take responsibility for your events. You are responsible for obtaining any consents needed from the players and guardians you add, and for complying with the rules of any venue, club, or governing body that applies to your event.

5. Matchmaking, other players & in-person meetups

VolleyForge can help players discover games and connect with one another. When you arrange or attend a game, you are meeting and interacting with other people in the real world at your own risk. You understand and agree that:

• VolleyForge does not screen, vet, perform background checks on, or verify the identity, character, or conduct of any user, and is not responsible for their behavior;
• VolleyForge is not a party to any meetup, game, or arrangement between users, does not supervise them, and does not control any venue;
• you are solely responsible for deciding whether to meet or play with anyone, and for taking reasonable precautions — meet in public places, tell someone where you are going, and stop if you feel unsafe;
• any dispute you have with another user is between you and that user, and you release VolleyForge from claims arising out of the acts or omissions of other users.

Your participation in pickleball activities arranged through VolleyForge is also governed by our Assumption of Risk & Waiver.

6. Reporting & safety

If another user makes you uncomfortable or behaves inappropriately, use the in-app tools to block and report them, and contact local authorities in an emergency. We review reports and may remove content or users at our discretion, but we cannot guarantee any particular outcome or response time, and we are not obligated to monitor the Service.

7. Subscriptions, billing & payments

Player accounts and independent self-serve leagues are free. Paid plans (such as Pro and Club+) are billed in advance on the interval you select (monthly or annually) and, unless cancelled, renew automatically at the then-current rate. You can cancel at any time from your account; your plan remains active through the end of the paid period, and you are not billed for the next one. Except where required by law, payments are non-refundable. We may change plan features and prices prospectively, and will give reasonable notice of a price change before it applies to you. Payments are processed by third-party processors, and your use of them is subject to their terms.

8. Your content

You retain ownership of the content you submit — such as your profile, league details, team names, messages, and match scores (“Your Content”). You grant VolleyForge a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely as needed to operate, provide, and improve the Service (for example, showing your standings on a public league page). You are responsible for Your Content and represent that you have the rights to submit it. We may remove content that violates these Terms.

9. Our intellectual property

The Service — including its software, design, logos, and brand — is owned by VolleyForge and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service under these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service except as the law expressly permits.

10. Third-party services

The Service may link to or integrate with third-party services (for example, map, email, sign-in, analytics, or payment providers). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any information (including standings, schedules, or ratings) is accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, VolleyForge and its operators, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any personal injury, property damage, lost profits, or loss of data arising from or related to your use of the Service, your interactions with other users, or your participation in any game or meetup — whether based on contract, tort, statute, or any other theory, and even if we have been advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless VolleyForge and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, your events, your interactions with other users, or your violation of these Terms or of any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if you violate these Terms, create risk for others, or if we discontinue the Service. Provisions that by their nature should survive termination (including content licenses you granted, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

15. Governing law & dispute resolution

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law rules. Before filing any formal dispute, you agree to first contact us and attempt to resolve the matter informally in good faith. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. You and VolleyForge waive the right to a jury trial and to participate in a class action; disputes must be brought on an individual basis. If any part of this section is found unenforceable, the remainder still applies, and any claim that must proceed in court will be brought exclusively in the state or federal courts located in Kansas.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after a change takes effect means you accept the updated Terms.
